For real estate transaction records, we are generally required to retain documentation for a minimum of four (4) years pursuant to Colorado Division of Real Estate regulations and applicable MLS rules. Communications and client records related to completed transactions will be retained for this statutory period.

Marketing-related data will be retained until you opt out or request deletion, after which it will be removed from active systems within a commercially reasonable timeframe. You may request deletion of your personal data at any time by contacting us using the information in Section 12.

GSD Broker Team / S.U.R.E. reserves the right to modify these Terms of Use at any time and without prior notice, subject to the notification provisions set forth in Section 11.8. Your continued use of the services following any modification shall constitute your acceptance of the revised Terms.

11.2 Use of Services

The services provided by GSD Broker Team / S.U.R.E. are intended solely for lawful real estate purposes. As a user of our services, you agree to the following conditions of use:

• You will use the services only for lawful purposes and in a manner consistent with all applicable local, state, and federal laws and regulations.

• You will not engage in any unauthorized data collection, scraping, harvesting, or extraction of content from our website or platforms, including property listings, client data, agent contact information, or proprietary market data.

• You will not reproduce, duplicate, copy, sell, resell, or exploit any portion of the services or website content without express written permission from GSD Broker Team / S.U.R.E.

• You will not use automated tools, bots, scripts, or crawlers to access, index, or interact with our website without prior written authorization.

• You will not transmit any harmful, offensive, fraudulent, or otherwise unlawful content through our platforms or communications channels.

No portion of the Content may be reproduced, distributed, publicly displayed, transmitted, adapted, modified, or used to create derivative works without the prior express written consent of GSD Broker Team / S.U.R.E. or the applicable licensor.

THE SERVICES AND ALL CONTENT PROVIDED BY GSD BROKER TEAM / S.U.R.E. ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GSD BROKER TEAM EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Any implied warranties of merchantability, fitness for a particular purpose, or non-infringement;

• Any warranty that the services will be uninterrupted, error-free, secure, or free of viruses or other harmful components;

• Any warranty regarding the accuracy, completeness, reliability, timeliness, or availability of property listings, market data, valuation estimates, or any other information provided through the services;

• Any warranty that defects in the services will be corrected; or

• Any warranty that the services will meet your specific requirements or expectations.

Property listing information is provided by third-party MLS systems and other sources and may not reflect the most current information available. GSD Broker Team / S.U.R.E. does not verify the accuracy of listing data and is not responsible for errors or omissions in such information.

11.5 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GSD BROKER TEAM, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or anticipated savings;

• Loss of business, data, goodwill, or opportunity;

• Property damage or personal injury resulting from your access to or use of the services;

• Unauthorized access to or alteration of your transmissions or data;

• Statements or conduct of any third party on or through the services; or

• Any other matter arising from or related to your use of the services.

IN NO EVENT SHALL GSD BROKER TEAM'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE USE OF THE SERVICES EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS PAID BY YOU TO GSD BROKER TEAM DURING THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

11.6 Indemnification

You agree to defend, indemnify, and hold harmless GSD Broker Team / S.U.R.E., its officers, directors, members, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your access to or use of the services;

• Your violation of any provision of these Terms of Use or this Agreement;

• Your violation of any applicable law, regulation, or third-party right, including intellectual property rights and privacy rights;

• Any misrepresentation made by you in connection with your use of the services; or

• Any dispute between you and any third party arising from your use of the services.

GSD Broker Team / S.U.R.E. reserves the right to assume exclusive control of the defense of any matter otherwise subject to indemnification by you, in which case you agree to cooperate fully in asserting any available defenses.

11.7 Governing Law and Dispute Resolution

This Agreement, including the Privacy Policy and these Terms of Use, shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in Mesa County, Colorado.

You waive any objection to the laying of venue of any such proceeding in Mesa County, Colorado, and waive any claim that any such proceeding has been brought in an inconvenient forum. Nothing in this section shall prevent GSD Broker Team / S.U.R.E. from seeking injunctive or other equitable relief in any court of competent jurisdiction.

11.8 Changes to Terms

GSD Broker Team / S.U.R.E. reserves the right, at its sole discretion, to modify, update, or replace these Terms of Use at any time and for any reason. When we make material changes to these Terms, we will update the "Effective Date" at the top of this Agreement and, where feasible, provide notice through our website or via email to users with active accounts or subscriptions.

Your continued access to or use of the services following the posting of revised Terms of Use constitutes your binding acceptance of such changes. We encourage you to periodically review this Agreement to stay informed of the terms governing your use of the services.
